REPUBLICATION AND REPUBLIC FORM
Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby the consumer is any natural person who enters into a transaction for purposes which are predominantly not attributable to their professional or self-employed activities:
A. Revocation policy
Right of withdrawal
You have the right to revoke this contract within fourteen days without giving reasons.
The cancellation period is fourteen days from the day on which you or a third party other than the carrier named by you took possession of the last goods.
In order to exercise your right of withdrawal, you must inform us (André Wagner, Heinz-Sielmann-Ring 2a, Germany, tel: 01758159305, e-mail: info@andre-wagner.com) by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to revoke this contract, you can use the attached model withdrawal form, which is not mandatory.
In order to safeguard the withdrawal period, it is sufficient that you send the notification about the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of withdrawal
If you revoke this Agreement, we will refund to you all payments we have received from you, including the delivery costs (except for the additional costs resulting from your choosing a different mode of delivery than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the date on which we received the notification of your revocation of this Agreement; we will use the same means of payment as you used in the original transaction, unless otherwise expressly agreed with you; in no case will you be charged for such repayment; we may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case within fourteen days from the date on which you inform us of the cancellation of this contract.The period is respected if you send the goods before the expiry of the period of fourteen days.
They shall bear the direct costs of returning the goods.
They shall only be liable for any depreciation of the goods if such depreciation is due to handling of the goods which is not necessary for checking the nature, characteristics and operation of the goods.
Exclusion or early expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods which are not prefabricated and for the production of which an individual selection or destination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal expires prematurely in the case of contracts for the delivery of goods if they have been mixed inseparably with other goods after delivery due to their nature.
The right of withdrawal does not apply to consumers who are not members of any Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.
Related/financed operations
If you finance this contract through a loan and subsequently revoke it, you are also no longer bound by the loan agreement if both contracts form an economic unit. This is to be assumed in particular if we are also your lender or if your lender makes use of our cooperation with regard to the financing of the loan. If the loan has already flowed to us when the revocation takes effect or when the goods are returned, your lender enters into our rights and obligations under the financed contract in relation to the legal consequences of the revocation or the return. If you want to avoid a contractual commitment as far as possible, make use of your right of withdrawal and also revoke the loan agreement, if you also have a right of withdrawal.
General instructions
1) Please avoid damage and contamination of the goods. Please return the goods to us in original packaging with all accessories and with all packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please provide adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us unfreely.
3) Please note that the aforementioned sections 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
